Mulaaa (Mulaaa Sdn Bhd) (“we”, “us” or “our”) is in the business of providing earned wage access to employees of our partner companies, subject to the following Terms and Conditions (“Terms”). By using and continuing to use the Site, you unequivocally and explicitly agree to be bound by these Terms. We may, in our sole discretion, modify these Terms with or without notice to you. Please continue to periodically review these Terms when using the Site. By continuing to access and use the Site after these Terms have been modified, you are unequivocally and explicitly agreeing to such modifications. In addition, when accessing information and or using particular services or features on the Site, you shall be subject to any posted guidelines or rules applicable to such information and services or features that may be posted from time to time, including, without limitation, any new features or functionality (including, without limitation, video and related projects) that augment or enhance the information, services or features. All such guidelines or rules are hereby incorporated by reference into these Terms.

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OUR SITE AND ANY OF ITS PAGES, YOU Unequivocally and explicitly AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS AND CONDITIONS, YOU MUST LEAVE THE SITE IMMEDIATELY AND CEASE TO CONTINUE USAGE OF THIS SITE FAILING WHICH, IT SHALL BE DEEMED THAT YOU HAVE UNEQUIVOCALLY AND EXPLICITLY AGREED TO BE BOUND BY THESE TERMS.

DESCRIPTION OF SERVICE

Subject to the terms and conditions herein imposed, Mulaaa provides a platform which allows you to access a portion of your earned wages (“earned wage access”) based on your completed workdays as per the records of your employer. By using and continuing to use the Site, you unequivocally and explicitly agree to your employer sharing your data (read more about this in our Privacy Policy) which is required by us to provide the services for your usage.

The Site and the information, features and services available through the Site may be referred to herein collectively as the “Service”. Unless explicitly stated otherwise, any new features or services that augment or enhance the Service in the future shall be considered part of the Service and subject to these Terms. We shall not be responsible or liable for the accuracy, completeness, usefulness or availability of any information or other content, data, text, URLs, graphics, audio and video clips, advertising or any other materials (collectively, the “Content”) transmitted or made available via the Service. We shall not be responsible or liable for any decisions made in reliance on such information.

REGISTRATION / ENROLLMENT

You may be required to register for and create an account with the Service in order to access certain information, products, services, and features offered through the Service. You are solely responsible for maintaining the confidentiality of your password(s) and for all usage or activity on your account, including the use of your account by any person using your password(s). If you choose to register with the Service or otherwise provide personal or other information to the Service, you agree to (a) provide true, accurate, current, and complete information about yourself as prompted by the Service’s enrolment process or other areas of the Service, and (b) maintain and promptly update such information to keep it true, accurate, current and complete. If there is any inconsistency in your data when you access the Service, you are required to notify your Employer immediately regarding such inconsistency and to ensure that your Employer notifies us accordingly in writing. As a condition of using the Service, you agree to the terms of Mulaaa’s Privacy Policy, which may be updated from time to time. ACCESSING EARNED WAGE

By agreeing to this Terms, you are unequivocally and explicitly agreeing for your Employer to make deductions of the sum withdrawn by you using the services provided by Mulaaa based on your earned wages prior to your Employer paying your salary for the calendar month. All Mulaaa withdrawals will be deemed as a company advance made at your request and as such will constitute as a payment of a proportion of your salary ahead of time based on your completed workdays subject to the terms and conditions imposed on such withdrawals. As such, it is important to ensure your account is only handled by you or an individual you fully trust. Mulaaa disclaims any liability in the event of any misuse of your account by any third party.

By agreeing to use this Service, you are further unequivocally and explicitly agreeing for your employer to make deductions of the transaction fee of RM18.99 for each withdrawal of your earned wages using the services provided by Mulaaa and the same shall be deducted by your Employer from your salary together with the amount withdrawn from Mulaaa.

SECURITY OF YOUR INFORMATION

We take the security of your information seriously and will take appropriate measures to protect it to the best of our ability by applying appropriate safeguards to protect your information, prevent loss and unauthorized use which includes but not limited to storing all personal data securely and limit access to only necessary personnel. We use industry-standard encryption technology when transferring and receiving your data. We will regularly review our security measures and update them as necessary. However, we expect you to take full responsibility to protect your personal and account information at your end that is within your control and custody, to your best ability. You are expected to use secure connections when using our platforms and we shall not be held liable for any loss or issues faced due to an insecure connection. You are also expected to take full responsibility over your login details and, thus, agree to regularly change your password to ensure security.

UNAUTHORISED ACTIVITY

If we believe there has been fraudulent or suspicious activity related to your Mulaaa account, Mulaaa reserves the right to immediately terminate, delay, or suspend your access to and use of our platforms until further notice.

CONSENT TO SHARING PERSONAL DATA

By agreeing to use this Service, you unequivocally and explicitly signify your consent to be bound by any and all agreements, terms and conditions, and contracts in your transactions with Mulaaa by clicking on the “Agree and Accept” or similar button while you are logged in at the Platform using your Login Information. You agree that these agreements, terms and conditions, and contracts are binding upon you in the same manner as if you physically affixed your signature thereon and you consent to the collection, use, transfer and disclosure of your data by Mulaaa, its subsidiaries and affiliates (collectively, “Mulaaa”) in electronic format or online, including but not limited to the following:

1. You consent to Mulaaa’s collection, use, transfer and disclosure of your personal data, including but not limited to your Name as per Identity Card, Employee ID, Employment Start Date, NRIC/Passport No., H/P No., Email, Payroll salary information, Payroll bank account details, Attendance data and such other related information from your employer for the purpose of providing the Services to you.

2. You consent to the collection, use, transfer and disclosure of your financial data, including but not limited to your salary details, credit card details, bank account numbers and other payment information, for the purpose of completing payments and/or remittance and other transactions related to the Services

OWNERSHIP

Mulaaa will own all Intellectual Property Rights related to the “Mulaaa App” developed and the Platforms’ contents including, without limitation, all copyright, trademark, patent, trade secret, and other proprietary rights in relation to the “Mulaaa App”. You are refrained from copying, publishing, using, integrating, promoting, combining our software, content, or brand without our express written permission to do so. You are refrained from using any electronic communication feature in the website for any purpose that is unlawful, tortuous, abusive, and intrusive on another’s privacy, harassing, libellous, defamatory, embarrassing, obscene or threatening.

Any unlawful use or any of the aforementioned actions will constitute a material infringement of our intellectual property rights and Mulaaa hereby reserves the right to file the appropriate criminal and civil complaints, cause the prosecution of such violators, register, and maintain any applications, registrations, and other documents related to such Intellectual Property Rights in ensuring the same is protected.

DISCLAIMER

This website and its content are provided on an "as is" basis without any warranties of any kind. The website and its content are provided without any representations, warranties or guarantees of any kind, either express or implied including, but not limited to, warranties of title or implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security or accuracy.

YOU EXPRESSLY UNDERSTAND AND UNEQUIVOCALLY AGREE THAT:

a. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE AND ALL INFORMATION, CONTENT, SERVICES OR PRODUCTS OBTAINED THROUGH THE SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS SUBJECT TO THE TERMS CONTAINED HEREIN. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, SERVICES OR PRODUCTS INCLUDED OR OFFERED ON OR THROUGH THE SERVICE.

b. YOU understand that the app provides a service for earned wage access and mulaaa is not responsible for any loss or harm incurred by you due to the use of the app. You also agree to indemnify and hold harmless the app and its creators from any claims or damages arising out of YOUR use of the app WHETHER THE SAME IS BEING USED BY YOU PERSONALLY OR ANY THIRD PARTY ON YOUR ACCOUNT.

c. WE MAKE NO WARRANTY THAT (i) THE SERVICES WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UN-INTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR ANY INFORMATION, CONTENT OR SERVICES PRODUCTS PROVIDED THEREIN WILL BE ACCURATE OR RELIABLE AND (iv) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR FROM OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE ORTHE INABILITY TO USE THE SERVICE OR ANY PRODUCT OBTAINED THROUGH THESERVICE; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (iv) ANY OTHER MATTER RELATING TO THE SERVICE.

We make no promises that the website or its content will meet your requirements, be uninterrupted, timely, secure or error-free. We do not warrant that any information, software or other material accessible through the website is free of viruses, worms, Trojan horses or other harmful components.

In addition, this Terms may be revised by Mulaaa from time to time without prior notice. You will be alerted if any major changes occur. By continuing to use the Platforms, you are bound by the most current version of the Terms.

Mulaaa and its partners, affiliates, directors, officers and employees shall not be held liable for any loss, damage, liability or expense incurred or suffered which are claimed to result from the use of our Platforms, under no circumstances.

You also agree to hold all above mentioned parties free and harmless from any liability arising from any loss or damage in all instances mentioned in the previous sections of this Terms and especially in the following instances:
1. The conduct of any user on our Platforms.
2. Delays on the use of our Platforms due to factors beyond our control.
3. Delayed or inaccurate information received due to failure or disruption of the communications used by Mulaaa to provide your services.
4. Loss or damage caused by fraudulent activities resulting from the theft or unauthorised disclosure of your Login information.

Your use of our Platforms is at your sole risk.

THIRD PARTY WEBSITES

The Service may provide links to websites or resources outside of the Site. Because we have no control over external sites and resources, you acknowledge and agree that we are not responsible for the availability of such sites or resources, and do not endorse and are not responsible or liable for any Content, advertising, goods, services or other materials on, available through or provided by such sites or resources. Your correspondence or business dealings with, or participation in promotions of, any websites that you find or link to through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such websites. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. TERMINATION

We reserve the right, in our sole discretion, immediately and without notice to suspend or terminate these Terms, your account (if you have registered) and/or your ability to access the Site, for any reason including any breach by you of these Terms or conduct by you that we determine to be inappropriate.
